I am a construction attorney representing contractors, remodelers and homeowners. I am legal counsel for the Atlanta Chapter of the Natl Association of the Remodeling Industry. I have represented the Natl Kitchen & Bath Association and the Association of Pool and Spa Professionals in GA. Home Maintenance & Repairs: What type of warranty should be given on shower re-do?

I have a shower pan leak, so the shower is being gutted back to the studs.and rebuilt. What type of warranty(s) should I be getting from the contractor? Any other suggestions would be appreciated too. Thanks.

    the manufacturer. For example, a shower pan may be warranted to 10 years but the labor warranted by the contractor for only 1 year. While a warranty is nice, it is not a substitute for doing your due diligence on the contractor to be sure they know what they are doing, check references and be sure that your contract specifies that they will follow all manufacturer's installation requirements so that the manufacturer's warranty is not voided. Often you can find the manufacturer's installation instructions online. Take lots of photos during installation, and use a tape measure to show distances. You'd be surprised later at how helpful they can be when trying to remember where pipes run behind walls and other issues.

    also the contractor's entity name on your contract. If you contract with Joe X Construction LLC, that should be the name on the insurance certificate. Not Joe X or Joe X Construction Company.

    response a little. As indicated, the EPA lead rules are not applicable to all homes and all work. The most important thing is using a qualified contractor, whether a NARI member or not to work on your home. If a roof issue, you may want to also verify that the roofer is a member of the NRCA (National Roofing Contractor's Association). Also check your state licensing requirements. You may also find my website: BewareofContractor.com helpful. Remember there are some great contractors out there but there are also a lot of bad ones and some who are scam artists. Roofing is one of those areas that you really need to perform your due diligence.

    I am assuming you wish to use a Kodak name of some sort. It's difficult to answer these kind of issues in the abstract. Although a name may not be in current use that does not mean that the trademark has been terminated or that there is not a use. Kodak is currently going through a bankruptcy sale of a lot of its assets and this could well be one of them. Generally I recommend starting with uspto.gov to look up whether there are trademark rights. But again, that does not mean that other uses are not permitted. For example, Delta Air Lines and Delta faucets. 2 completely different businesses. Also remember that pinning your name to another's mark has its own risk. A few years ago, the Lance Armstrong name was probably gold, now it's a anchor or worse.

    Lastly, I am not a trademark/patent attorney and there could be other nuances. If you are building a "name" for marketing and a business, it may be worthwhile to discuss it with an attorney who specializes in that area. Once you explain your specific facts, it may only take minutes to answer and get a definitive answer rather than general legal information which is all that I can offer. You may want to look at Avvo.com (which also rates attorneys).

    agent--if its not covered, a low cost rider may be available. They should be able to explain to you what may be covered by your policy and where the county's responsibility ends/ My very general oversimplistic understanding is that if it a leak before the meter, its their problem but if after the meter, its your cost.
