The Humane Society have non lethal animal traps and if you use one of them with goodies inside that usually works

Feed him away from where you are having trouble. Give him stale cereal, crackers, cookies, granola, bread, birdseed(not dried corn), it may keep him away from going into the gardens. If he persists, a mouse trap baited with peanut butter will scare him to death when it snaps! I have never actually caught a squirrel or chipmunk in them, but they stay away from that area for a good long while. I also use cayenne pepper and grated irish spring soap original scent. They both seem to keep away the squirrels, chipmunks and rabbits.

Take cat litter with the urine only and spread around edges of yard - this marks the area as off limits.
