Once you touch the stairs... they will have to be brought up to current building codes... HomeAdvisor.com or Angieslist.com are free referral services... that recommend only verified companies.... a structural engineer will have to tell you what the requirements are and how the job needs to be done

You have to tear out the staircase and rebuild it.

Rose is right or are you talking about the depth of the treads?

You need to replace the whole thing, stringers and all. Keep in mind that it will take up more room (the staircase will be longer).

Older homes often have stairs that do not meet modern code. Those stairs are grandfathered to the code that was in effect at the time they were built, and do not require rebuilding before the property is sold.

If you are referring to a new stairs that was improperly built, existing too short treads can be removed and replaced with deeper treads as long as the nose of the tread does not extend more than 1 & 1/2 inch beyond the front of the riser below the tread.

An afterthought: you cannot just add another board on top of the existing treads because this changes the height of the rise and both first and last rise will be different than they used to be. This variation is riser height causes tripping and violates code.

Yes they are short. Should be 10". Can't add to them or replace them. The stringers, which are the sides the treads are nailed to, are made for the size of treads wou have. The whole staircase would need to be replaced.
