An enamel paint should work but I would check the label to see if it's non-toxic. Different manufacturers use different chemicals
You can paint your metal bird bath with any kind of spray paint for metal, then use a pot bottom or plastic bottom (the kind you put under houseplants to put in your bird bath. I have a large planter bottom that I put in my concrete bird bath. So much easier to clean and fill, and keeps my concrete from cracking in the winter. When it's really hot outside, I put ice cubes in my bird baths.

I've just coated my rusty bird bath with a primer called FerPrime rust converter from Fuze. The company told me it's resin based so non toxic and it was very simple to use. Dried to a nice matt dark grey finish in less than half and hour and doesn't need a top coat.

Marine paint, for pools, has some lovely colors and is safe. Have you thought of moving the birdbath to a shady spot? If there is no shady spot, consider purchasing a sun loving small tree, or large potted plant to put near the bath. Birds will appreciate this and enjoy the shade as well as the branches for perching.

See above and link to article. Treat with a rust converter product like FenPrime. Then paint with enamel paint for kids toys.
