Nope, it's a Bay Leaf, Laurus nobilis.
Yup it is an olive tree . . . They can be messy especially stepping on fallen fruit, it can stain. Keep them picked up! You are so lucky, you can brine your own olives and make olive oil, how cool is that????

I thought the top pic looked like a Mountain Ash. The berries are usually bright orange, but can sometimes be black.
