It looks like a small sweet gum tree.
Pick off one of the leaves, and take down to a home improvement store. Garden section....someone there could tell you.

I was thinking that because I saw some little ones nearby. No, it is not something you want in your yard. I planted some plum trees that are doing the same thing and I am going to remove them. There are little ones coming up all over from the tree roots. They have large thorns and are a pain to pick the plums and the branches droop making it difficult to walk under them.
