You can legally cut the roots and any part of the tree that goes onto your property. I would dig around the roots, use a saw (sawzall) and cut them below the ground level and pour rock salt to prevent them from growing. A neighbor across the street had a large sycamore tree, over 30 feet tall. The large leaves in the fall were everywhere. The roots were encroaching onto his neighbors property. It would have cost $2,000 bucks to cut it down so the owner did nothing. The other neighbor just dug around the tree on his property and every week poured a bag rock salt into the pit he dug and watered. In six months the tree died and the owner was forced to have it cut down. The neighbor originally offered to split the cost of the removal but the owner refused.
