At first glace at this picture I would have said mesquite but mesquite do not have berries. They have beans. But the mesquite leaves look a lot like this. I agree the leaves don't look like china berry but the berries do. No idea...

I'd say a Pepper tree also. But really, check with the Santa Clara Master Gardener program. They have a huge web site and they helped me a lot when I was trying to figure out what I had in my overgrown Sunnyvale back yard and the people are great and very knowledgeable

I think it is a Pepper tree, the little buds turn pink in the fall. They are very messy, but I have picked branches of the berries, and sprayed them with a fixative and used them to decorate with.
