Chicken wire is your friend when it comes to this problem If you have a fence around your garden, you can put it about 4 inches deep below the fence. If you just have a small piece of your garden that you want to protect, you can build a chicken wire fence (pretty simple!) around the patch of garden that you want to protect, again, going about 4 inches deep. Good luck!
The fence is the only thing that worked for me. Another option would be use a live trap, then contact animal control and have them relocate it.
