Does look like a gardener snake. I remember being a kid and freaked out when I learned snakes could swim.... I thought I was safe in the water. I don't know how big your fish are but they will eat fish. He will crawl out eventually, but if he has learned there is a food source there he will be back. I get snakes in my pond too. As long as they are not venomous I leave them alone. It is probably just in to regulate it's body temp and will move on.
He is fine, snakes like this are good for the garden. If you want him out, fish him out with a net and let him move on.

I think he's a cute snake. He's not a garter snake, but he's not poisonous either.
Even looking at the picture the snake freaks me out ! I would try to catch him (rather ask someone to do it) and bring him far far away....
