i dont know what animals....but spray your kale with hot sauce, put human hair in the area.
Try putting aluminum pie pans on strings and hang them close to the kale ( within a few feet max) and most animals won’t go near it.
You would be surprised what creeps through your yard at night. Could be any number of things. Welcome to the world of gardening! How about placing a fence around your garden or motion lights - most creatures of the night do not like light.

Not sure what you mean by "how far down" to plant kale...depth won't matter. Yes, there are lots of critters that could be to blame, but most don't like used coffee grounds. Ask your local coffeeshop to save you some and spread them around plants you want to protect. Starbucks are usually pretty helpful and generally have about 10 lbs bagged for me at the end of the day. You may need to reapply every few days if critters are really determined. Coffee grounds are nontoxic and a good source of nitrogen for plants. You should also check your yard for holes where rats, woodchucks or other undesirables might be living. Read up on how to control them and make your yard inhospitable. Don't ignore them or they will quickly multiply! Best of luck!
