I would think it would depend on how your crockpot heats. If it has heat coils only in the base, rather like a heating pad, than a liner that does not touch the sides of the pot probably would be okay. If the sides of the pot get warm when it's heating then I don't think enough heat would be transfered to the liner if it was not touching. Have you tried contacting the manufacturer to see if replacements are available? Otherwise I would take the empty liner with me to thrift stores and yard sales to find a replacement. It may be easier to buy a secondhand whole crockpot.

Don’t know why not. You could also haunt Salvation Army and Goodwill stores for a new insert.
Look up manufacturer on line and see if you can buy a replacement or get an answer from them. I always call manufacturers for questions like this.
There is a heating element in the wall of the crock pot that needs to be in contact with the ceramic insert in order to heat what's inside. Some, but not all, crock pots have the heating element in the bottom or bottom and side. If you are going to use a smaller size, you need to be aware where the heating element is. Plug it in, put on the lowest setting and gingerly feel for the heat.
Check local Goodwills and Salvation Army and other charity stores for crock pots. Most of them are less than $10 and you'll probably find a good match.
They have those disposable plastic liner bags now made for crockpot. It's given a second life to my cracked, but otherwise working older crockpot.
