Dan's of Central Florida, Inc. on Feb 08, 2012If it is entirely on your property then I see no reason you can not do with your fence as you wish (baring an HOA or something similar). Your neighbor can not do something that damages your property. It would be similar to the neighbor deciding they didn't like the look of it and knocking it down I would think, then again I am certainly no lawyer - though we do have one that is a member here. Perhaps he will chime in if/when he sees this.Helpful Reply

Woodbridge Environmental Tiptophouse.com on Feb 09, 2012Paint it bright red! That will fix him. Realistically this person is your neighbor, you need to get along. You need to inform him that you need to do maintenance to the fence not only for your reasons, but to keep the fence looking good for him to look at. If he says you cannot go on the property you need to seek the advice of the building department and if they are not willing to help, seek the advice of a local attorney who will sort this issue out for you. Its hard when someone will not work with others, but it does happen from time to time. But do the neighborly thing first and tell them what you want to do and if he would mind you doing this. But if they fight and you end up with permission only by going the harder route. Paint it an obnoxious color. They cannot touch this if its on your property.Helpful Reply
