What kind of tree do you have? There maybe too much shade in your yard, for new seed to grow. I would first have a soil test, I think you can buy these at Lowes, then test it. You will then know if there is a chemical issue that needs correcting, or if the tree needs trimming to allow more sunshine to hit the lawn area. With this time of the year, I would not plant grass seed, it is still winter. I would wait till May, to plant grass seed, and wet the grass first, or wait til the sunset hours, for the moisture to come, and this will help you also. J.

How about a rock garden? If you're not having success with grass, go with some gravel and rocks. That could be really pretty as well.
Maybe you need to overseed with a shade grass seed? Why are you thinking it is the gardeners fault?
He seems to cut with blades too low. I was testing sod and it seemed to be working (I had it roped off in the beginning) but when he went over it the pieces of sod were ripped out. What does it mean to "overseed"?
