Looks like it might be a Persimmon Tree.
The waxy leaves look like a maagnolia. What area of the country?

It certainly resembles "salal" so you may want to check that out. Not sure if it grows on the East coast. It is often used in flower arrangements on West coast and makes a nice garden plant.
Male Persimmon Trees don't bear fruit. I have one in my yard. Take a limb to Lowe's, there should be someone there that can identify your tree in the garden

no scent to the leaves? Hmmm. We have a tree in our yard as well that we have no idea what it is. i like the idea to take a branch to Home Depot or Lowes. Maybe a picture of the whole tree too. Any in the area that resemble it? Take a photo of those too.
Take one to your local extension agency, they should be able to identify it.
Could be a Wild Cherry.
If I had to guess, I would say Bay Leaves, I have them growing in my backyard.
