There shouldn't be a problem! Make sure it isn't loose or flaking before you paint over it.
Check out 1001pallets.com for info on pallets. If it is just spilled paint, yes, it is fine. This site will tell you what to look for in found pallets and whether they are safe to use. Some are chemical treated and have more limited use. Good luck and happy building!
I would say go for it. And if you don't like it when your done just spray paint a new color on them
I believe blue means heat treated for higher temps..not sure on the red
