that is evidently an error in the installation of the niche. Why make a shelf that can't hold anything? The contractor should remedy this or perhaps a wire shelf could be installed here to hold the bottles. You should not have to make the correction.
I would talk to the contractor. He did the job and it didn't last, so he should fix it so that it doesn't slant down and the job is done right. He should have some kind of guarantee that goes along with his work.
Hopefully he used a two part epoxy to mount the shelves. I agree, you should have him correct the slant. There should some form of warranty for his work.
If you're only using the shelves for a few things, they might be strong enough, but ask him what he used and how long he's going to guarantee it for you, or will he use something stronger to re-do the upper while he's fixing the bottom shelf.
