Can I get some help identifying this tall plant in my kids' garden?

My DIL says it's almost 4' tall and it has small yellow blossoms. That spiky thing is a fruit. They're wondering if they should just let it be or rip it out. I have the time to sit here and research it, they've got 3 little ones underfoot =D. I've looked around Google and weed identifying websites with NO luck! Anyone here have any ideas? I'd be really grateful. The plant has sprung out of their raised flower bed so there's no way it was already in the ground. It's some bought soil, some some potting soil. They mostly started their garden from seeds but they sure didn't plant this one! Thanks, all!
