looks like holly tre
Holly leaves usually have a shine to them and are a deeper green. Not sure what it is, but doesn't look like holly to me. Found this site to help you though http://www.gardenguides.com/105554-identify-shrubs-berries.html.
Maybe a Mayhaw? Holly has prickly leaves and is a bush. Elderberries grow in grouped bunches and are a deep purple and is also a bush ( https://maxpull-gdvuch3veo.netdna-ssl.com/wp-content/uploads/2009/04/Elderberry-1024x682.jpg )
I think they look like red currants.
