Is the head triangular? Do you live near a body of water? It looks like a water moccasin to me. My husband killed one in our pond a couple of months ago.

It is a non venomous black rat snake. Pretty good critter to have around!
That little lovely is a black rat snake. He is a great snake to have around as long as you don't keep chickens. If you have chickens he WILL steal eggs and be a greedy pig about it, too if he can get to them. Otherwise he'll keep the rodents down around your property quite efficiently. He is also very territorial and will not allow other snakes around, so he'll keep the copperheads and other nasty, poisonous snakes away. I have one in residence in my shed, and make sure not to disturb his nest and there's never a mouse in sight!

If its' eye pupils are round, not slits, it is not poisonous.

Black rat snakes are great to have around your property. Just leave it alone and it will leave you alone. Your pic is interesting in another way... See how he looks "crinckled" not smooth. Looks like its' muscles are gathered? I saw a black snake do that in my yard when it moved onto bark mulch. Like the mulch irritated its' skin.
