Hi Jack! Well, in order to get a good up-draft, you really need to have the chimney to be higher than the roof peak. I would check with the municipality to see what the regulations are. Remember too that you need a certain clearance for any trees and a "critter" stopper on the top. Hope this helps!
And please have your chimney sweep come annually. Better safe than sorry. ;-)
Basic codes will follow national fire code. 2 feet higher than the highest roof peak within ten feet. This also includes neighboring homes.
