It is either a Gulf or Variegated Fritillary. Not poisonous to the touch. They become a Fritillary butterfly, which is orange and black.
If it is on a Butterfly milkweed plant or any milkweed plant they will chew the leaves up and become a Monarch butterfly and the caterpillar is orange and black which you do not see much of anymore but they look for this type of plant to lay there eggs on. the butterfly plant will usually have orange or yellow flowers on them. so if it chews the leaves the plant will reproduce or come back next year.So I hope it is a Monarch.

Euptoieta claudia this is a Fritillary larvae. Average sized butterfly, mostly orange.
