They may be fungus gnats. Do you have houseplants nearby? if so they may be over watered. Fungus gnats like damp soil.
They could also be drain flies. You can Google those.
If you have them in your plants, disturb the soil and they will fly up, you need to repot sooner than later. Discard the soil, do not reuse it for anything, clean the pots out with bleach water and rinse with straight vinegar and leave on for a few minutes before you rinse that out to kill the fungal spores. Gently rinse the plants and roots to make sure no eggs are present, as those gnats breed in the soil. Repot in fresh soil and make sure the plants aren't kept too moist on the surface. You can use gnat attractant or a fly strip to catch any flies left. If they aren't in the plants, put boiling water down your drains by where you see them. Make sure that you don't have any thinned skinned fruits or vegetables on the counter and wash any fruit you plan on having on the counter. If you have potatoes or onions in a cupboard or anywhere, check them for spoiled spots that they may feed in and breed. I hope this helps.

Gnats or black flies! Wash down the area that you find them in. Then use fans to blow them outside.
Call your pest control person.
